These Terms of Service ("Terms") govern your use of arklaywgs.com and the services provided by Arklay Website & Graphic Solutions ("Arklay," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.
Our services
We provide custom website design and development, graphic design, website hosting, and ongoing care plans. Prices shown on our website are starting estimates. The final scope, deliverables, and price for project work are confirmed in a written quote or proposal before work begins.
Quotes, deposits & payment
Project work begins after you accept a quote and pay a 50% deposit, which reserves your place in our schedule. The remaining balance is due on completion, before final files are released. Subscriptions such as hosting, Care Plans, and retainers are billed monthly in advance. Refunds and cancellations are governed by our Refund & Cancellation Policy. Overdue accounts may result in paused work or suspended hosting until the balance is settled.
Your responsibilities
You agree to provide the content, materials, access, and feedback we need to complete your project in a timely manner. You confirm that you own or have permission to use any materials you provide to us — including text, images, and logos — and that they do not infringe the rights of any third party.
Revisions & scope
Each project includes the revision rounds described in your quote. Work requested beyond the agreed scope may be quoted and billed separately.
Intellectual property
Upon full payment, you own the final deliverables we create for your project, for their intended use. We retain ownership of preliminary concepts that were not selected, and of our own underlying code, tools, and techniques. Any third-party components — such as fonts, stock media, plugins, or libraries — remain subject to their own licenses.
Portfolio rights
Unless we agree otherwise in writing, we may display completed work and reference your business name in our portfolio and marketing materials.
Hosting & availability
We make reasonable efforts to keep hosted websites available, secure, and backed up, but we do not guarantee uninterrupted or error-free service.
No guarantee of results
We deliver professional, high-quality work, but we cannot guarantee specific business outcomes such as traffic volumes, search engine rankings, or sales.
Disclaimer & limitation of liability
Our website and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amount you paid us for the service giving rise to the claim, and we are not liable for any indirect, incidental, or consequential damages.
Indemnification
You agree to hold Arklay harmless from any claims arising out of materials you provide to us or your misuse of the deliverables we create.
Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law principles.
Changes to these Terms
We may update these Terms from time to time. Continued use of our website or services means you accept the current version.
